How many drinks does it take to have a 0.08 alcohol concentration?
The answer is not quite as straightforward as you may think. Alcohol is a poisonous substance. As soon as you put alcohol into your body, your body begins attempting to remove it. Alcohol concentrations rise when you drink more alcohol, and when you drink at a faster rate than your body can eliminate the alcohol. A person's weight and fat content plays a large part in how much you can drink and not be intoxicated.
80% of alcohol is absorbed through the small intestine, while only 20% is absorbed in the stomach. Therefore, if you have food in your stomach, the alcohol can't pass to the small intestine, thus delaying the time before you become intoxicated.
However, there is no true "magic formula" to determine how many drinks an individual may have before his or her blood alcohol concentration exceeds 0.08.
What should I do to avoid a DUI?
The best advice is not to combine alcohol and driving. If you are going to drink, drink responsibly: plan ahead for a designated driver, or take a taxi.
What should I do if I get stopped after I have been drinking?
First of all, don't panic. If stopped after dirnking, it is important for you to listen to the questions asked. You are required to show proof of a valid driver's license and valid insurance when stopped by law enforcement. You should have these ready for the officer or know where to find them easily anytime you're driving.
Let the officer tell you why you were stopped. If the officer asks you where you have been or are going, you should understand that he or she is trying to engage you in conversation to see if you are in the right frame of mind to be driving.
Always be polite and respectful when speaking with law enforcement officers.
Should I perform the Standard Field Sobriety Tests?
Remember that the Standard Field Sobriety Tests are voluntary, and you may decline to perform them. The Standard Field Sobriety Tests consist of an eye test, a heel-toe walk, and standing on one leg. These are not simple exercises and are difficult to do perfectly even under the best conditions. By agreeing to do these tests, you are just giving the officer more damaging information to put into his report for the prosecutor to use at your trial.
I failed the breath test. Is my license suspended?
Yes, but is does not take effect for 30 days. You will be given a temporary license good for those 30 days. Oklahoma law grants you fifteen (15) days to contest the revocation of your license and request an administrative hearing. If you request a hearing within this time limit, you will have the opportunity to contest the lawfulness of the revocation.
